These Terms govern the website, hosted app-testing services, integrations, and support provided by On A Lark LLC, a company organized in the United States ("Ramus," "we," or "us"). "You" means the person or organization accepting these Terms. You agree through signup or another action clearly presented as acceptance. If acting for an organization, you represent that you have authority to bind it. All users, including guests, must be at least 18. Contact: legal@ramus.dev.
1. Right to use the Services
Subject to these Terms and applicable service limits, Ramus grants you a limited, nonexclusive, nontransferable right to use the Services for authorized development, testing, and debugging. Authorized users and guests may use supported access paths. No rights are granted in third-party applications or platforms except by their respective owners.
2. Restrictions and customer responsibilities
You must provide accurate account information, protect credentials and share links, and obtain the rights, notices, and permissions required for your content and activities. You are responsible for use you authorize, but not for unauthorized activity caused by Ramus's breach. Guests remain responsible for their own conduct and content. Notify us of suspected unauthorized access.
You must not use the Services unlawfully, infringe others' rights, access systems without authorization, unlawfully intercept communications, conduct unauthorized malware activity or scanning, disrupt systems, or circumvent security or resource limits. Comply with applicable export controls and sanctions. Mandatory legal and open-source rights remain unaffected.
You must not upload, enter, display, or store Sensitive Data as defined in the Privacy Policy. Ramus will remove detected prohibited information from active use and initiate deletion, subject to legal preservation and applicable deletion requirements. This does not create a duty to screen all content. The Services are not offered for uses requiring specialized regulated-data arrangements.
3. Intellectual Property
"Customer Content" includes applications, source code, inputs, test data, logs, recordings, and other materials supplied or processed for you. You and your licensors retain ownership. You authorize Ramus to host, copy, build, execute, transmit, display, and troubleshoot Customer Content only as necessary to provide your requested Services and troubleshoot them, including through the providers described in the Privacy Policy.
Ramus does not sell information or use Customer Content for advertising, model training, general product development, or unrelated reuse. After termination, this permission continues only for agreed return or deletion and legally required preservation or disclosure. Ramus remains responsible for obligations delegated to its providers, subject to applicable law and the limitations in these Terms. Ramus retains ownership of its technology and documentation.
Each party will protect the other's nonpublic confidential information with reasonable care, use it only for authorized purposes, and disclose it only to persons who need access and are bound by appropriate confidentiality duties. Private Customer Content is confidential without a label. These duties exclude information lawfully known without restriction, independently developed, lawfully received without a confidentiality obligation, or made public without breach. Required legal disclosures must be limited to what is necessary, with notice where permitted. Confidentiality survives while the information remains confidential.
4. Privacy and data protection
The Privacy Policy describes information handling, including automatic session replay. The Ramus DPA forms part of these Terms where Ramus processes Customer Personal Data on your behalf. Any required transfer particulars must be completed before the affected transfer.
6. Plans, payment and support
Ramus offers a free plan and paid subscription plans, as described on our pricing page. Accounts created before paid plans were introduced are on an Early access plan. Plan features, limits, and prices may change, and the free and Early access plans may be changed or discontinued, with notice as described in section 11. No future feature, free tier, or successor service is promised.
Paid plans are monthly subscriptions, billed in advance for each monthly period, and renew automatically until canceled. You agree to a paid plan only by completing checkout; these Terms do not authorize moving you to a paid plan without that agreement. You can upgrade, downgrade, or cancel at any time in your account settings. An upgrade takes effect immediately and may be charged a prorated amount for the rest of the current period. A downgrade or cancellation takes effect at the end of the current period, and you keep your plan until then. Fees are non-refundable, including for partial months, except where required by law.
Payments are processed by Stripe. Stripe may sell paid plans to you as merchant of record, in which case Stripe's terms for that purchase also apply, Stripe may calculate and collect applicable taxes, and your receipt may name Stripe or Link as the seller. Prices are in US dollars, and taxes may apply in addition to the listed price. If a payment fails and is not resolved within the retry period, your subscription may be canceled and your account moved to the free plan.
Plans include a monthly allowance of device minutes that resets on the 1st of each month (UTC); unused minutes do not carry over. When an allowance is used up, new sessions are refused, and a running session ends shortly afterward, until the allowance resets or you change plans. We currently don't count time with no input for over a minute; we may change how minutes are counted with notice. Unlimited minutes remain subject to these Terms, the Acceptable Use Policy, idle timeouts, and available capacity.
We provide an initial substantive response to support requests at legal@ramus.dev within 72 elapsed hours, including weekends and holidays. This does not guarantee resolution within that period, uptime, or service credits. Maintain independent copies of your work; Ramus is not a permanent archive.
7. Suspension and termination
Ramus may suspend affected access as reasonably necessary for material breach, unauthorized access, security threats, unlawful activity, material harm, or binding legal requirements. We give notice and a reasonable opportunity to resolve the issue where practicable and lawful; urgent circumstances may require immediate action. Contact us to request review.
You may stop use and request account closure. Either party may terminate for material breach not cured within 10 days after notice; an incurable breach or urgent security, legal, or material-harm circumstance may justify earlier termination where lawful. For planned discontinuation, we give 30 days' notice where reasonably practicable and maintain existing download access during that period where practicable and lawful.
Access ends on termination. Return and deletion are governed by the Privacy Policy and applicable DPA. No recovery of expired data or new export tools is promised except as required by law or the DPA. Ownership, confidentiality, content restrictions, accrued obligations, liability, dispute, and data-return/deletion provisions survive as relevant.
8. Warranties and disclaimers
To the maximum extent permitted by law, except for express commitments in this Agreement, the Services are provided "as is" and "as available," without warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, or noninfringement. Ramus does not guarantee uninterrupted or error-free operation, app compatibility, complete test results, or accurate or reliable AI outputs. Mandatory statutory rights remain unaffected.
9. Limitation of liability
To the maximum extent permitted by law, Ramus will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, data, or use, arising out of or relating to the Services or this Agreement, even if advised of the possibility.
Ramus's total aggregate liability arising out of or relating to the Services or this Agreement, under any legal theory, will not exceed the lower of (a) US$100 or (b) the fees you paid Ramus during the six months before the event giving rise to the claim. If no fees were paid during that period, the cap is zero. Related claims do not increase the cap.
These limits apply to confidentiality, privacy, security, intellectual-property, and other claims to the extent lawful. They do not restrict nonwaivable liabilities, mandatory remedies, or rights and liabilities under applicable standard contractual clauses where such restriction is prohibited. The cap limits Ramus's liability, not yours. Neither party undertakes a special contractual duty to defend or indemnify the other.
10. Disputes and governing law
The laws of the State of New Mexico, United States, govern this Agreement, subject to mandatory law. Disputes may be brought in competent courts in Santa Fe County, New Mexico, preserving mandatory consumer forum rights. This Agreement does not require arbitration or waive class actions or jury trials.
11. General provisions
Neither party may use the other's name or trademarks for publicity without permission. Assignment requires consent, except to a successor in a merger or sale of substantially all the relevant business that assumes these obligations. Assignment cannot expand permitted data uses.
Send legal notices to legal@ramus.dev. We give email and in-product notice of material amendments, with 30 days' advance notice where practicable. Urgent legal or security changes may take effect earlier; renewed agreement is obtained where required. Amendments do not retroactively expand content permissions or alter accrued claims without legally effective agreement.
Invalid provisions will be limited or severed as law permits. Nonenforcement is not waiver. The parties are independent contractors. No third-party beneficiaries are intended except under mandatory law or applicable transfer clauses. These Terms and validly incorporated agreements govern their subject matter. Mandatory law and applicable transfer clauses prevail; the DPA controls processing conflicts within its scope; a negotiated agreement controls other conflicts it expressly addresses. The Privacy Policy and documentation do not expand Customer Content permissions or override confidentiality.
